The “baby tax” headline makes for good politics. But it’s not really what this debate is about. The bigger issue is what happens when tax rules force families to make long-term decisions today about circumstances that could look completely different years from now. Families change. Children are born. Grandchildren arrive. Relationships and financial circumstances evolve. That flexibility is one of the reasons discretionary trusts exist in the first place. So if preserving favourable tax treatment requires families to effectively lock in certain arrangements, we need to understand ALL of the consequences before these reforms take effect. We’ve already seen concerns raised, concessions proposed and now questions emerging about what those concessions could mean when a family changes. Good tax policy shouldn’t require Australians to predict their family tree years into the future. Do you think these trust reforms need to go back to the drawing board? Let me know in the comments.
