What Aussies are allowed to say online should NEVER come down to the opinion of one politician. That’s the part of the proposed Digital Duty of Care laws I think deserves far more attention. The government says the reforms are about making online platforms responsible for preventing serious harms, particularly harms affecting children. The exposure draft also lists categories of “serious harm” and would allow the Communications Minister to designate additional harms. That proposed ministerial power has already triggered free-speech concerns from the Opposition, while Communications Minister Anika Wells has said she’s open to changing the draft so Parliament, rather than the minister alone, could decide what meets that threshold. Protecting children online matters. But so does protecting freedom of expression.
